1. Agreement to Terms
By accessing or using doggydrain.com ("Website") or purchasing products from DoggyDrain ("we," "us," "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use our Website or purchase our products.

2. Products and Services
Made-to-Order Products:
All DoggyDrain products are made-to-order.
For Europe (EU/EEA/UK/Switzerland): Products are custom-made to customer’s specifications (groin height, color, version, unique ID).
Product Descriptions:
We strive for accuracy in product descriptions, images, and specifications. However, we do not warrant that descriptions are error-free, complete, or current. If a product is not as described, your remedy is limited to return and refund as outlined in our Return and Refund Policy.
Pricing:
All prices are displayed in local currency and include Product cost and the cost of Standard shipping (typically 5 to 14 days), Duties, and Taxes (DDP pricing). Prices are subject to change without notice. The price charged is the price displayed at the time of your order.
3. Orders and Payment
Order Processing:
When you place an order, your payment method will be authorized (but not charged immediately) and you will receive an automated order confirmation email. You will only be charged once we are ready to start production, at which point we will capture your payment.
We reserve the right to cancel orders for reasons including payment verification issues, product suspension, pricing errors, suspected fraud, or circumstances beyond our control. If we cancel your order, we will notify you promptly, void the payment authorization, or refund your payment, as appropriate.
Cancellation by Customer:
You may cancel your order before we capture payment by contacting returnandrefunds@doggydrain.com. Once payment is captured, customer-initiated cancellation is subject to our Return and Refund Policy.
Payment:
Payment is processed securely through Shopify's payment processing system. By providing payment information, you represent that you are authorized to use the payment method.
Production Start:
Production begins immediately upon our capture of your payment. Once payment is captured, orders cannot be cancelled by customer (see our Return and Refund Policy for details).
For Europe (EU/EEA/UK/Switzerland): By placing an order, you expressly request immediate production upon payment capture and acknowledge that you waive your right of withdrawal for customized goods under the Consumer Rights Directive. See our Return and Refund Policy for full details.
4. Cancellations and Returns

5. Shipping and Delivery

Title and Risk of Loss:
Title and risk of loss pass to you upon delivery to your specified shipping address.
6. Intellectual Property
Patent-Pending:
DoggyDrain is protected by pending patent applications and other intellectual property laws.
Prohibited Uses:
You may not:
- Copy, reproduce, or commercially manufacture our products without written permission
- Create derivative works that compete with our products
7. Prohibited Activities
You agree not to:
- Use the Website for any unlawful purpose
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the Website or servers
- Transmit viruses, malware, or harmful code
- Impersonate any person or entity
- Collect user information without consent
- Use automated systems (bots, scrapers) without permission
8. Limitation of Liability
To the maximum extent permitted by law:
We are not liable for:
- Indirect, incidental, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Damages exceeding the amount you paid for the product
Product Use:
DoggyDrain products are intended for dog use as described. We are not liable for:
- Misuse or improper installation
- Damage to property from improper use
- Injury to pets or persons from misuse
Exceptions:
Nothing in these Terms excludes or limits our liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any liability that cannot be excluded under applicable law
9. Warranty

Disclaimer:
Except for the warranty described in our Return and Refund Policy, products are provided "as is." We disclaim all other warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
10. Indemnification
You agree to indemnify and hold harmless DoggyDrain, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of our products or Website
- Your violation of these Terms
- Your violation of any third-party rights
11. Governing Law and Dispute Resolution
Governing Law:
These Terms are governed by the laws of Hong Kong SAR, without regard to conflict of law principles.
Dispute Resolution:
Any dispute arising from these Terms or your use of our products/Website shall be resolved as follows:
- Informal Resolution: Contact us at info@doggydrain.com to attempt good-faith resolution
- Jurisdiction: If informal resolution fails, disputes shall be subject to the exclusive jurisdiction of the courts of Hong Kong SAR
Consumer Rights:
Nothing in this section affects your statutory rights as a consumer under applicable law (e.g., EU consumer protection laws, China Consumer Protection Law).
12. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed from these Terms. The remaining provisions shall remain in full force and effect.
13. Entire Agreement
These Terms, together with our Privacy Policy, Shipping Policy, and Return and Refund Policy, constitute the entire agreement between you and DoggyDrain regarding your use of our Website and products.
14. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of our Website after changes constitutes acceptance of the modified Terms.
